Digital Millennium Copyright Act (DMCA) Notice
ViralRemake ("the Platform", "we", "us") respects the intellectual property rights of creators, artists, and brand owners. In accordance with Title 17 of the United States Code, Section 512(c) (the Digital Millennium Copyright Act or "DMCA"), we respond expeditiously to valid notices of claimed intellectual property infringement and maintain a policy of terminating repeat infringers in appropriate circumstances.
1. Designated DMCA Agent
Notices of claimed copyright infringement should be sent to our Designated Copyright Agent via email:
- Designated Agent: DMCA Compliance Officer
- Email:
dmca@viralremake.com - Backup Contact:
support@viralremake.com - Subject Line: DMCA Takedown Notice - ViralRemake Platform
2. Filing a DMCA Takedown Notice
To submit a valid notice of claimed infringement, please provide a written communication containing the following mandatory elements:
- Identification of the Protected Work: A description of the copyrighted work or trademark that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
- Identification of the Infringing Material: Sufficiently specific information to allow us to locate the material on the Service (such as the exact URL link, tool slug, or generation identifier).
- Contact Information: Your full legal name, mailing address, telephone number, and email address.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (including fair use).
- Accuracy and Penalty of Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright or intellectual property owner or are authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of the copyright owner or authorized representative.
3. Review and Takedown Procedure
Upon receipt of a substantially compliant DMCA notice, ViralRemake will:
- Promptly remove or disable access to the challenged material;
- Notify the user responsible for uploading or generating the challenged material;
- Provide the affected user with a copy of the takedown notice, enabling them to submit a formal counter-notification if they believe the removal was mistaken.
4. Counter-Notification Procedure
If a user believes their material was removed or disabled as a result of mistake or misidentification (such as lawful fair use or license), the user may submit a Counter-Notification to our Designated Agent containing:
- Identification of the material that has been removed or to which access has been disabled, and the location where it previously appeared;
- A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- The user's name, address, and telephone number, and consent to the jurisdiction of the Federal District Court for the judicial district in which the user is located (or if outside the United States, any judicial district in which ViralRemake may be found);
- The user's physical or electronic signature.
Upon receipt of a valid counter-notification, ViralRemake will forward it to the original complaining party. Unless the copyright owner notifies us within ten (10) business days that they have filed an action seeking a court order against the user, ViralRemake may restore the removed material.
5. Repeat Infringer Policy
Under appropriate circumstances and at our sole discretion, ViralRemake maintains a strict repeat infringer policy. Accounts found to have repeatedly uploaded infringing materials or unconsented likenesses will have their privileges terminated and access revoked.
6. Nominative Fair Use and Parody Clarification
Please note that ViralRemake operates as a creative computational sandbox. References to popular culture, memes, and aesthetic styles are community-driven transformative parodies and are evaluated in light of fair use and nominative fair use doctrines. If you are a rights holder seeking brand clarification rather than content removal, please specify this in your inquiry to legal@viralremake.com.
