By accessing, visiting, or using the ViralRemake platform, websites, or services ("ViralRemake", "we", "our", or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

ViralRemake provides an AI-assisted creative video studio that processes user-submitted text prompts, images, and creative parameters to render video clips, motion animations, and synthesized audio. We reserve the right to update, modify, or discontinue features of the platform at our discretion.

3. User Accounts and Eligibility

You must be at least 13 years of age (or the age of legal majority in your jurisdiction) to use ViralRemake. You are responsible for safeguarding your account credentials and for all activities conducted under your account.

4. User Upload Warranties & Right of Publicity (Likeness Consent)

When you upload any portrait photo, likeness, character image, or asset to ViralRemake, you expressly represent and warrant that:

• Legal Ownership or Explicit Consent: You own the submitted content or have obtained all necessary licenses, permissions, and explicit consents from any natural person whose face, likeness, or voice is depicted.
• Prohibition on Non-Consensual Likenesses: You will not use the Service to generate deepfakes, defamatory portrayals, deceptive impersonations, or non-consensual depictions of any individual.
• Minors: You will never upload images depicting minors or use the Service to generate content that exploits or endangers children.
• Zero Tolerance: Violation of likeness consent warranties results in immediate, non-refundable termination of your account and potential reporting to competent authorities.

5. Acceptable Use and Prohibited Conduct

You agree not to use ViralRemake to generate, upload, or disseminate:

• Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, or invasive of another's privacy.
• Non-Consensual Sexual Imagery (NCII) or sexually explicit deepfakes.
• Content designed to deceive, commit fraud, manipulate elections, or spread dangerous disinformation.
• Materials that infringe any patent, trademark, trade secret, copyright, right of publicity, or other proprietary rights.
• Automated scraping, brute-force attacks, or actions that interfere with server operations.

6. Nominative Fair Use & Third-Party Trademark Disclaimer

ViralRemake's catalog includes community meme templates, creative parodies, and artistic motion presets inspired by viral internet culture:

• Independent Platform: ViralRemake is an independent technology platform. We are not affiliated with, sponsored by, endorsed by, or partnered with any referenced luxury brands, sports leagues (such as the NFL), athletic organizations, entertainment studios, or public figures.
• Nominative Fair Use: Any names, trademarks, titles, or public figures mentioned on our platform are referenced solely under the doctrine of Nominative Fair Use to identify aesthetic styles, cultural humor, and internet meme phenomena for transformative artistic purposes.
• No Trademark Rights Claimed: ViralRemake claims no trademark or proprietary ownership over third-party marks or franchises.

7. Transformative Parody & Fair Use

Our preset formats are designed as transformative artistic tools for satire, parody, commentary, and comedic self-expression. Users generating and distributing parody content are advised to ensure their downstream usage respects applicable fair use principles in their local jurisdiction.

8. Audio and Soundtrack Licensing

Audio synthesized within ViralRemake consists of royalty-free algorithmic ambient effects and original synthetic beats:

• No Commercial Master Recordings: ViralRemake does not distribute, host, or sell copyrighted commercial master audio recordings.
• Social Media Publishing: When posting generated videos to third-party platforms (such as TikTok, Instagram Reels, or YouTube Shorts), users are encouraged to attach trending soundtracks using each platform’s official, licensed in-app audio library.

9. Intellectual Property and Generated Content

• Your Inputs: You retain all existing ownership rights in the source images and text prompts you provide to the Service.
• Generated Outputs: Subject to your compliance with these Terms, ViralRemake assigns to you all right, title, and interest in the specific video files generated by your account, subject to the inherent legal framework of AI-generated content in your jurisdiction.
• Commercial Usage: Videos generated with purchased credits may be used commercially for their generated videos, provided such content complies with all third-party rights and likeness rules set forth herein.

One-time payments and credits

Prices are shown in USD before checkout. We sell single-video purchases and one-time credit packs, with no new subscriptions or automatic renewals. Current prices and model-specific credit requirements are listed on Pricing. Available reference cuts depend on the template and model; the editor shows the exact charge before generation. Credits are added only after a successful payment and do not expire. Failed renders return the exact reserved credits.

Previously purchased subscriptions remain accessible for review and cancellation from Account → Manage subscription. Their existing paid periods, credit balances and billing records are preserved. See the Refund Policy for unused purchases, previous subscription purchases and payment reversals. Stripe processes payments; we do not store card numbers.

10. DMCA Safe Harbor & Copyright Infringement Takedown

ViralRemake complies with the provisions of Title 17, United States Code, Section 512 (the Digital Millennium Copyright Act). If you believe your copyrighted work or trademark has been infringed by content hosted on or generated through our Service, please refer to our DMCA Policy or email our designated agent at dmca@viralremake.com.

11. Indemnification

You agree to defend, indemnify, and hold harmless ViralRemake, its parent entity, affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) any content or photo uploaded by you; (c) your infringement of any third party's copyright, trademark, privacy, or publicity rights; or (d) your downstream distribution or monetization of generated video outputs.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ViralRemake and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business reputation, arising from your access to or use of (or inability to use) the Service.

13. Modifications to Terms

We may update these Terms periodically. We will indicate the date of the latest revisions at the top of this document. Continued use of the platform after updates constitutes your binding acceptance of the revised Terms.
